     ความหมายของพรบ.

     คำว่า พรบ. ในทางประกันภัยที่เรียกกันอย่างติดปากทุกวันนี้ ที่จริงแล้วมีความหมายมาจากคำว่า พระราชบัญญัติคุ้มครองผู้ประสบภัยจากรถ ซึ่งถูกตราเป็นกฎหมายมาตั้งแต่ปี 2535 นั้นเองครับ แต่ก็มีการเปลี่ยนแปลงและแก้ไขรายละเอียดมาเรื่อยๆ จนถึงปัจจุบันนี้ โดยหลักๆ ก็คือ พระราชบัญญัติฉบับนี้จะคุ้มครองผู้ประสบภัย ที่ได้รับความเสียหายอันมีสาเหตุมาจากรถยนต์นั่นเอง โดยจะเป็นคนเดินถนน หรือ คนใช้รถบนท้องถนนไม่ว่าจะเป็นผู้ขับขี่หรือผู้โดยสาร ก็ได้รับความคุ้มครองทั้งหมด แม้ไม่ทราบว่าผู้ก่อเหตุเป็นใคร ผู้เสียหายก็ยังได้รับความคุ้มครอง สำหรับ พรบ ตัวนี้ ในทางประกันภัยเรียกว่า กรมธรรม์ภาคบังคับ

 สาเหตุที่ กม. บังคับให้รถทุกคันต้องทำก็เพื่อ

            1.คุ้มครองและช่วยเหลือผู้ประสบภัยจากรถ ให้ได้รับการชดใช้ค่าสินไหม

            2. เพื่อเป็นหลักประกันว่าสถานพยาบาล จะได้รับค่ารักษาอย่างแน่นอน

            3. เพื่อให้ธุรกิจประกันภัย มีส่วนร่วมในการแบ่งเบาภาระของรัฐบาล ด้านสวัสดิสงเคราะห์

     จริงๆ พรบ.ภาคบังคับ ตัวนี้มีประโยชน์มากนะครับในทางปฎิบัติ เพราะอย่างน้อยก็ช่วยแบ่งเบาค่าใช้จ่ายเรื่องการรักษาพยาบาลให้แก่ผุ้ประสบเหตุทางรถยนต์ โดยเฉพาะผู้ที่มีรายได้ไม่มากนัก อย่างน้อยก็อุ่นใจว่าจะได้รับการดูแลรักษาเบื้องต้นครับ
